In this agreement, we have referred to the LexAdvice service as the “service”, to you as the “user” and to our agreement as the “agreement”. We have considered that you are 18+ year old if you are coming to our website and putting kind of details or not, it means you are validating this agreement and accepting the terms of use.
LexAdvice’s Role
LexAdvice is a panel that arranges and facilitates communications between professionals and visitors of the website. LexAdvice does not guarantee that user or visitor will successfully find Chartered Accountants Company Secretary or Advocates or any other professional according to their wish. We have developed an electronic platform (www.Lexadvice.in) through which we are rendering services related to communication between seekers and renderers of it.
The terms & conditions enclosed herewith are an electronic record as per Information Technology Act, 2000 and rules there under as applicable and as amended from time to time. This agreement is generated by a computer system hence doesn’t need any physical or digital signatures or validation. Provisions of Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended from time to time) are applicable. These conditions are binding and legally enforceable between the Company and User.
Changes to these Terms of Use
Please take note that the terms and conditions which are mentioned here may be updated or modified from time to time as required by the company. We guide you to review the terms from time to time so that you can be aware of the changes done. In case of company introduces any kind of application, API, auto auto-filing facility. By visiting our website you note and agree that the Company is only acting as a technology facilitator for the tax filing or other kind of filing wherein the role of the Company is limited to the extent of providing the Platform to you.
The information mentioned on the website is only meant for information and awareness purposes, hence not declaring any kind of communication or advice to its users. For the fulfillment of your need on the basis of the request made by you, we will arrange for a professional to render you the services. USER GUIDELINES
The users or visitors of LexAdvice have limited or restricted rights to access and use the service in accordance with the rules that are described in this contract. LexAdvice reserves has sole right to deny further access to its service to any user who violates these rules or otherwise as decided by LexAdvice. By accepting this agreement, you are declaring that you will not be involved in any of the abovementioned activities with the intention to harass any of LexAdvice ‘s associates or any other connected person.
If you are found to violate any rights not limited to the intellectual property rights of reserved by LexAdvice, such things shall lead to penal prosecution. You are liable to not use any of Intellect Property Rights or other properties belonging to LexAdvice this includes using the service for acts of actual copyright, trademark, patent, trade secret, or other intellectual property infringement.
Some Points Need to consider
Every government or non-government-related transaction requires third-party approval because we deal with a variety of government organizations. Hence we are not in a position to guarantee you the time frame taken for the service you have taken from us, approval of these kind of services are subject to third-party processing. If specified transactions are communicated via email, WhatsApp, phone conversation, or any other mode, an average time period can be expected as per service. It is not the responsibility of LexAdvice or any other entity associated with LexAdvice to deliver services on time in case of any delay from the government department or otherwise.
It is not significant for any kind of refund processing if our manpower is put into a service that is rejected by the department for which we are taking charges.

INDEMNIFICATION
By accepting our terms, you are giving your consent that LexAdvice is not responsible for any kind of cause of harm to any user or visitor while using our service. You are agreeing to indemnify, defend, and hold LexAdvice harmless from and against any and all liability and costs incurred in connection with any loss, liability, claim, demand, damage, and expenses arising from or in connection with the contents or use of the service. You are agreeing that this defense and indemnity shall also apply to any breach by the user of the agreement or the foregoing representations, warranties, and covenants.
PROPRIETARY RIGHTS

UNLAWFUL ACTIVITY
LexAdvice reserves all rights related to investigating any kind of complaints or violations of the Agreement and to take any action that is appropriate and deems fit including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses, and traffic information.
SEVERABILITY OF PROVISIONS
These Agreements (terms & and conditions, privacy Policy, Refund Policy) constitute the entire agreement with respect to the use of the service offered by LexAdvice. If it is found that any provision of these Agreements (terms & conditions, privacy Policy, Refund Policy) is unlawful, void, or unenforceable then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
MODIFICATIONS TO TERMS OF USE AND SERVICES
LexAdvice has the sole right to update the usage of terms of this website at any time and updatation of such conditions does not create liability on LexAdvice to provide updates to its users. The user is responsible for checking the Terms and Conditions before use. Use of the service after the change will indicate acceptance of the new terms and conditions. LexAdvice has the sole right to modify or pause, discontinue, or stop whether temporarily or permanently, the service with or without any prior notice to the user in any way. Upon termination or discontinuation of any services, LexAdvice may have the sole right to immediately delete data and files in the user’s account and bar any further access to such files or the Service.
LIMITATION OF LIABILITY
The user agrees that LexAdvice shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or the inability to use the service or for the cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through or from the service or resulting from unauthorized access to or alteration of user’s transmissions or data, including, but not limited to damages for loss of profits, use, data or other intangibles, even if LexAdvice has been advised of the possibility of such damages. The user further agrees that LexAdvice shall not be liable for any damages arising from interruption, suspension, or termination of service, including, but not limited to direct, indirect, incidental, special, consequential, or exemplary damages, whether or not such interruption, suspension or termination was justified, negligent, intentional or inadvertent.
JURISDICTION
Any kind of dispute controversy or claim arising out of or relating to this Agreement or LexAdvice services shall be liable to settle in the courts of Delhi. No other jurisdictions shall be entertained. Any other dispute or disagreement of a legal nature will also be decided in accordance with the laws of India, and the Courts of Delhi shall have jurisdiction in all such cases.

REFUND POLICY & CANCELLATION
We are focusing on providing good services with complete transparency. Your satisfaction is our priority and we are making all efforts for customer satisfaction. In case you are not satisfied with our services, you have the right to ask for a refund of money subject to certain conditions. However, it must be considered that the company has the sole right to decide whether the amount will be refunded or not. No user can force or assume that they will get a full amount refund.
Refund & Cancellation Policy
Before processing any refund, we reserve the right to make the best effort to complete the service irrespective of its time frame. In such cases, LexAdvice has the right to decide about the refund process. The costing which is incurred for the process of the transaction plus some additional cost for the manpower consumed as decided by us shall be liable to be deducted from the whole amount.
LexAdvice will not be considered if there is a breach of its satisfaction guarantee policy or default under any terms of service, and shall not be liable to the Client for any cessation, interruption, or delay in the performance of its obligations by reason of earthquake, flood, fire, storm, lightning, drought, landslide, hurricane, cyclone, typhoon, tornado, natural disaster, the act of God or the public enemy, epidemic, famine or plague, action of a court or public authority, change in law, explosion, war, terrorism, armed conflict, labor strike, lockout, boycott or similar event beyond our reasonable control, whether foreseen or unforeseen (each a “Force Majeure Event””).
For making a request of a refund you shall be liable to raise your concern at contact.lexadvice@gmail.com by mentioning all relevant proof causing delay or cancellation of processing or service.
We are not liable to make any kind of refund for services processed under which we have put our energy, manpower, government fees, processing charges, maintenance costs, resources, and all others.
The Refund shall be only considered in the event there is a clear, visible deficiency with the service or product purchased from LexAdvice. In the event a customer has paid for a service and then requests for a refund only because there was a change of mind, the refund shall not be considered as there is no fault, defect, or onus on LexAdvice.
For any kind of refund or cancellation process, you have to write a email at contact.lexadvice@gmail.com within 15 days from the date of payment.
